Terms of Service: Document Screening
1. What the service is
kidcheck screens PRIIPs Key Information Documents and related data files (EPT/EMT) against the requirements of Regulation (EU) 1286/2014 and Delegated Regulation (EU) 2017/653 using automated checks, supplemented by manual verification of selected findings. The output is a findings report identifying potential non-conformities for your review.
2. What it is not
The service is a screening aid. It is not legal advice, not a legal-conformity certification, and not a substitute for review by qualified legal or compliance professionals. A “clean” result means our checks found no defects; it does not warrant that a document complies with all applicable law. Responsibility for the content, accuracy and regulatory compliance of your documents remains entirely with you.
3. Scope and method
Checks cover, among others: prescribed template structure and wording, mandatory sections and statements, page and format limits, risk-indicator presentation, cost-table internal arithmetic, and document dates against review obligations. The current check list and known limitations are described in our published methodology. Screening reflects the regulation as we understand it on the date of the report.
4. Your materials
You confirm you are entitled to share the documents you submit. We use them only to perform the service, retain them and the findings for up to 12 months for quality and audit purposes unless you request earlier deletion, and do not disclose them to third parties. Aggregated, anonymised statistics (never identifying you or your documents) may be used in our research publications.
5. Confidentiality
Findings reports are confidential to you. We will not publish or share findings that identify you or your products without your consent, except where the documents concerned are publicly available and the findings result from our independent research outside this engagement.
6. Free checks
Free screenings are provided “as is”, without any warranty and without liability of any kind, to the maximum extent permitted by law.
7. Paid services: liability cap
For paid services, our total aggregate liability arising from or related to an engagement is limited to the fees actually paid for that engagement. We are not liable for indirect or consequential loss, including regulatory sanctions, remediation costs, or claims by your investors or distributors. Nothing in these terms excludes liability that cannot be excluded by law (including damage caused intentionally).
8. No third-party reliance
Reports are prepared for you alone. Third parties (including regulators, distributors and investors) may not rely on them, and no duty of care is owed to them.

10. General
Polish law governs; the courts competent for our seat have jurisdiction. If a provision is invalid, the remainder stands. These terms apply unless a signed agreement states otherwise.
